Activist supporting CJI Gogoi, demanded Men’s Rights Activist in ICC panel

After the allegation of sexual harassment against CJI Gogoi, three member committee of Justice Bobe, Justice Indira Banerjee and Justice Ramana constituted to conduct an enquiry in the matter.

Activist for men’s rights (MRA), were demanding the constitution of internal complain committee (ICC) per the act of “Sexual Harassment at Work Place”.

The activists demanded the participation of at least one activist (MRA) in the panel of ICC. They given example of Late Swaroop Raj, who killed himself due to allegations by her female colleague working at Genpact.

These activists also demanding equal punishment to the complainant if the allegation found false at any stage. They have opinion that, punishment in false case are very low or rare even after cases found false by courts. Due to low rate of punishment in false cases, is encouraging wrong doers.

The activist came in support of CJI Gogoi and also pointed that, CJI had already complained the behaviour of the women to the administration before the dismissal of the women from her job. They demanded fair trial in the matter.

The activist demanded enquiry in every matter before lodging the complaint and also demanded gender neutral law in place.

Recently in a 20 year old case of repe, where the accuse was given relief by Supreme Court, and the bench has mentioned their observation that “women was in habit of implicating all the persons by making wild allegations..”. The bench even after observing such harassment with men where he was harassed for more than 20 years, the bench had not taken any action against the prosecutrix women. The bench said as;

“Fifth, it had also come in evidence that the prosecutrix was in habit of implicating all the persons by making wild allegations of such nature against those with whom she or/and her husband were having any kind of disputes;”

The activist also concerned about the independence of judiciary. That if any women can accuse the Chief Justice of India, then situation is really challenging for Men, and it may create fear among the judges of lower courts. This may also impact other institutions.

That when any such allegations comes on any men, the whole main stream media and women rights groups, declares the person guilty as soon as the complaint filed against the man, without understanding the gravity of the situation and its impact on the life of the person.

The activists questioned that, these main stream media and female right groups prefer to remain silent if women doing wrong. They gave an example of Kiren Bedi, that recently her son-in-law Rujbeh was arrested by Pune Police in the kidnapping of his own daughter and later he was released after the issue highlighted on social media by MRA, but the matter was not taken up by any main stream media.

One of the senior activist Anil Kumar (MRA) from Banglore said that “there should be an end of discrimination with men in the name of women safety and women empowerment”.

Activist Amit Lakhani from Delhi said that, only fair trial can bring justice and real equality between the society.

Advocate and Activist PS Rao from Hyderabad demanded for “Committee to reexamine and review of Nirbhaya Act and addition of the misuse clause in the act”.

Activist Kumar from Delhi demanded involvement of MRA in the ICC, and added that “every view must be heard”.
