Bombay high court acquits a man who was awarded death sentence by sessions court in Thane district in the 2012 gang-rapes case of two women who were rag pickers.
The Bombay High Court acquits an accused observing the evidence is neither clear, cogent nor credible.
The court clearly stated that the prosecution failed to produce evidence against the accused. The division bench of Justices Sadhna Jadhav and Prithviraj Chavan refused to uphold the sentence awarded to the man, and acquitted the accused Rahimuddin Shaikh.
“This can, at the most, be a case of strong suspicion and no more. From the evidence, it is also apparent that the murder was neither preplanned nor premeditated. The evidence is neither clear, cogent nor credible. There is no question of awarding death sentence to the accused, rather, it is the case wherein the accused must be given the benefit of doubt, nay, it would be a travesty of justice,” the judgment read as published by TOI.
