A magistrate court in Mumbai acquitted a man who attempted to commit suicide in 2017 after being rejected by a woman. Therefore, a person has been booked under section 309 of the Indian Penal Code (IPC). As per this section states that “Whoever attempts to commit suicide and does any act towards the commission of such offence, shall be punished with simple imprisonment for a term which may extend to one year. “

Magistrate KH Thombre said, “The evidence that the accused stabbed himself in the stomach or consumed poisonous substance to commit suicide is absent from the records. Circumstances alone are not sufficient to establish that the accused attempted to commit suicide due to break in love affair. The prosecution has to establish that the accused had hurt himself and consumed poisonous substances to end his life. None of the prosecution witnesses testified that they saw the accused stabbing himself in the stomach with a knife or consuming any poisonous substance at the relevant time. In the absence of clear evidence to establish the guilt of the accused, the accused cannot be bound with the charges framed against him.”

On May 13, 2017 prosecution filed the case for a man living in the Khar area of ​​Mumbai who had stabbed himself in front of the woman’s house. When police reached the spot and took him to Bhabha Hospital and police received information from the attending doctors that the youth had also consumed poison.

Thereafter, on May 12 a woman lodged a complaint with the police that she was threatened by a man. And next day, the man drank the poison and attempted suicide.

As per preliminary investigation, it was found that between 2011 and 2016, the young man was having an affair with a woman in the college.

In the court, the woman said that the accused came to her house, beat the door and hence, she lodged a complaint about the incident in the police station.

On the day of the accident, the accused again went to his house and treated him the same way. This time his mother opened the door and saw that the accused was bleeding from his stomach. However, no one knew how the accused got injured.
