The bench of Justice Ashok Bhushan AND Navin Sinha granted protection from arrest which was rejected by High Court of Rajasthan on the ground of their quashing application has been rejected.
The bench said that the application for the anticipatory Bail have to be considered on merit.
“The fact that petition under Section 482 Cr.P.C. was dismissed for quashing was not conclusive and could not be the reason for rejecting the application.”
The High Court of Rajasthan, dismissed the application of anticipatory Bail in Feb 2018 filed for mother-in-law and father-in-law.
Then the husband of the complainant filed and special leave petition (SLP) No.1530 of 2018.
Jul 2019, the bench granted the protection from arrest with the condition to cooperate in investigation.
“In above view of the matter, we dispose of this appeal providing that the appellants shall cooperate with the investigation and appear as and when they are called by a written notice. However, appellants shall not be arrested during investigation.”
