Former CJI Dipak Misra : Not to Criminalize marital rape, will impact Indian Family

Former CJI, discussed about family system and shred his personal view on criminalizing marital rape.

BENGALURU : Monday, in an inaugural session of ” National Conference on Transformative Constitutionalism in India”, shared his view on criminalization of marital rape.

The former CJI, shared his opinion when a question asked by a student in the interactive session. The first year law student asked opinion to make rape law gender neutral and criminalization of marital rape.

The Times of India (TOI) published that, in his reply, the formal CJI Dipak Mishra, said that “because some country has made marital rape an offence…I donot think it should not be regarded as an offense in India..”

He added that “We still have family values, we still respect the family background and many other fecets”.

In his reply the former CJI has also opined that, India sustained due to values for family and such law may create anarchy in the families.

He further shared his opinion on the issue in Delhi over the sharing of power between LG and the Delhi Government, said that this need to be guided by Constitution Morality. He also said that “Individual imperialism has no space in democracy“.
