NRI husband alleges Wife parents not allowing her to come, moves Gujarat HC

A Non-Resident Indian (NRI) husband approached Gujarat High Court, alleging Wife parents not letting her come to matrimonial home.

Wednesday, the bench of Ms. Justice Sonia Gokani and Mr. Justice MR. Justice N.V.Anjaria ordered to produce the women “through video conference from the nearest district court”.

“to be presented before us through video conference to be arranged at the nearest District Court in presence of the Presiding Officer”, the bench said.

The NRI husband filed a ‘habeas corpus’ petition in the Gujarat High Court to free his wife from custody of her parents. In his petition, he has also apprehended threat to his wife’s life.

“applicant that in May, 2020 when she came to India, her parents did not allow her to return to Canada nor are they permitting her to join the petitioner. He is apprehensive that her life is in danger”

The petitioner husband, Giriraj Singh, who is originally resident of Rajasthan has got permanent residency of Canada, married with Ankita Chaudhary on 26.01.2018 before the Registrar General, Ontario, Canada.

He alleged that his wife is not allowed to return to Canada by her parents, after she came to India in May this year. He also alleged that she is not allowed by her parents to meet him.
